Alabama Mom Files Lawsuit Against Police for Tasering Sick Daughter

On July 9, 2015, a woman filed a lawsuit against at least eight police officers whom she says used Tasers on her and her daughter at a hip-hop concert in January, while the girl was suffering a grand mal seizure.

The lawsuit alleges that five or more officers from Rainbow City, Alabama, and three officers from Gadsen who were working security at a Kevin Gates concert, used excessive force, torture and “other cruel, inhuman and degrading treatment.” It also names Rainbow City chief of police Greg Carroll and the venue, Center Stage. The woman and her teenage daughter, whose names have not been released, are seeking damages for medical expenses, pain, emotional distress, and attorney’s fees, as well as punitive damages. The suit reportedly reads: “The actions of the…defendants…were unjustified, unprovoked, and objectively unreasonable and constitute a violation of their rights under the Fourth Amendment and/or the Fourteenth Amendment to be free from the use of excessive force.”

The woman’s attorney, Gregory Harp, told AL.com that, “A Taser was used three times on a child’s chest, during a medical emergency, while she was pinned to the ground by officers. Other officers present at the scene failed to intervene. Her mother was knocked to the ground, handcuffed, and then she herself Tased and arrested.”

The suit says the girl suffered a seizure when the surging crowd knocked her to the ground. When her younger sister told an employee what was happening, the girl was carried to the lobby and “unceremoniously dumped” on the floor, where police then placed her in a chokehold. The younger girl called her mother, who alleges that when she arrived she was “held down on the ground at five different points of her body” by police, restrained and then tasered. The suit says the girl was also tasered three times while her arms were restrained. She was taken to Gadsden Region Medical Center after she lost consciousness and her mother was arrested for disorderly conduct.
